Banana Republic of Germany Law & Law

Scandal: Pension insurance only pays for the last four years, even if there is a mistake

If there are errors in a pension decision and the pension insurance company makes mistakes, only the last four years of earnings will be paid. In Germany, pension rights expire after four years. So if you find out after 16 years that your application for disability pension was correct and that you could have been receiving a pension for 16 years, only the last four years will be taken into account. What is particularly unfair about the German regulation is that overpaid pensions must be reimbursed in full by the recipient, i.e. without a statute of limitations. This is particularly a scandal if the error lies on the part of the pension insurance company, which e.g. B. was wrongly rejected, or simply ignored years that were paid in.

Hardly any compensation for incorrect pension notices >>

Errors excepted.
